Terms of sale

1. General Provisions

1.1 These Terms of Sale apply to the purchase of goods and services ordered via the online store www.pats.ee (hereinafter "Web Store") managed by Päts OÜ (registry code 12326631, address Jaama pst 15, Rakvere, Estonia, hereinafter "Päts").

1.2 The Terms of Sale apply to all agreements and purchases concluded between Päts OÜ and the customer.

1.3 By using the Web Store and placing an order, the customer confirms that they have read and agree to these Terms of Sale, Privacy Policy, and Cookie Policy.

2. Prices and Payment

2.1 All prices are in euros and include 24% VAT.

2.2 Prices do not include delivery fees, which are displayed during checkout.

2.3 Payment is made during the order process via bank link, debit, or credit card. The order becomes effective once the payment has been received. Payments are processed by EveryPay (AS LHV Paytech).

3. Ordering and Delivery

3.1 The customer confirms the order by selecting the desired products and completing the order form.

3.2 Ordered products can be collected at an agreed location and time from Päts OÜ café in Rakvere or delivered to the customer’s specified address within the Rakvere area. 

3.3 Standard delivery time is 1-3 business days unless agreed otherwise.

3.4 If the order cannot be fulfilled, the payment will be refunded within 14 days.

3.5 Päts is not responsible for delivery delays caused by third parties (e.g., transport services) or the customer's inaction.

4. Cancellation and Returns

4.1 Orders can be cancelled at least 24 hours before fulfillment by sending an email to info@pats.ee, including the order details and bank account information.

4.2 In accordance with § 53 (4) clause 4 of the Law of Obligations Act, the 14-day right of withdrawal does not apply to perishable food items.

4.3 Claims must be submitted via email along with photographs. If the error is on Päts OÜ’s part, we will refund the payment or replace the product.

4.4 If the order is not cancelled in time or not collected, the payment will not be refunded.

5. Complaints and Allergen Information

5.2 For information on the ingredients and allergens in food and beverages, please contact us via email or phone.

Liability and Force Majeure

6.1 Päts OÜ is not liable for non-fulfillment or delays in fulfilling orders due to force majeure events, including natural disasters, strikes, supplier delays, third-party actions, or other unforeseen circumstances.

7. Intellectual Property

7.1 All texts, photos, recipes, and other content published on the Web Store and social media belong to Päts OÜ unless stated otherwise.

7.2 Copying, distributing, or using this content without written permission is prohibited.

Privacy policy

1. Processing of Personal Data

1.1 The data controller is Päts OÜ.

1.2 We process personal data (name, contact details, purchase history, payment information) for order fulfillment, customer service, business analysis, and marketing.

1.3 The legal basis for processing personal data is the contract (e.g., order fulfillment), legal obligations (e.g., accounting), and the customer’s consent (e.g., newsletters or marketing materials).

2. Security and Data Sharing

2.1 Personal data is protected by technical and organizational security measures.

2.2 Data is not shared with third parties except when necessary for service provision (e.g., payment services, logistics providers).

2.3 Customers have the right to access, correct, delete their data, and withdraw consent for marketing materials by emailing info@pats.ee.

2.4 Personal data is stored only as long as necessary to fulfill its purpose or as required by law (e.g., accounting documents for 7 years).

2.5 Personal data related to pending, failed, or cancelled orders is retained for 31 days, after which it is deleted. Data related to fulfilled or refunded orders is retained for 3 months, after which it is deleted.

 

3. Use of feedback

3.1 Päts OÜ collects feedback from customers regarding products and services after orders, via social media, in person, or through surveys.

3.2 Customer-provided feedback (including text, ratings, photos, etc.) may be used for marketing purposes (e.g., on the website, social media, promotional materials), unless the customer explicitly opts out.

3.3 Customers who do not wish their feedback to be used in marketing may notify us at info@pats.ee.

3.4 Publicly shared reviews (e.g., on Google, Facebook, Instagram) may be used with a reference to the original source.

Marketing terms

Päts OÜ reserves the right to:

  • – use photos and descriptions of completed work (food, events, orders) on its website, social media, and in marketing materials, unless otherwise agreed;
  • – include the names and logos of clients in its list of partners or portfolio;
  • – use collected feedback to improve product and service quality, and for marketing purposes, unless the client has explicitly objected.
